More instances of witnesses against public corruption supposedly committing suicide.  They were murdered to keep them quiet.  Apparantly they did not comprehend their own "Doug-Pick" thinly veiled death threat warnings.

Here is the real skinny:

  • The DC Madam did not   commit suicide as the media are reporting.  In fact, she even predicted that she would be killed and it would be made to look like a suicide.   Hmmmm.... Corruption of public officials, prostitutes in D.C., death threats ... Eliot Spitzer come to mind?

  • The retired NY State Trooper who was involved with the security detail for Eliot Spitzer did not commit suicide as the media so quickly and dutifully reported:

                Berwick hanged himself with a rope that apparently broke, with his body falling to the floor, according to the source.

    Yeah... Right... the rope broke. ... then how did get choked to death?   Could we at least get CSI on the scene?   They didn't even try to make it look like a real suicide.  They want the other Trooper to get the message and keep quiet.  His wife had another explanation of the crime:

                A State Police source said Berwick's wife, Maggie, blamed her husband's longtime employer for his death when police officers first arrived at her home. "When the SP [State Police] showed up, she started saying something to the effect, 'You guys are responsible for this,' although when people she knew arrived it all cooled down," the source said.

    The sad truth is we've got some corruption so deep it is a wilder story than an episode of "Law & Order".   We aren't suprised that ball players take steroids.  But truth is stranger than fiction. How about the unreported truth of large law firms regularly violating the law by filing false sworn affidavits as they engage in Bankruptcy Rings, a form of organized crime just as illegal as a prostitution ring, but with a lot more money involved.  Of course, a prostitution ring has always been a useful tool in the arsenal of organized crime families to buy, bribe, seduce & extort other lawyers, officials, law enforcement, claims agents, state bar officials, zoning board officials, or even the Judiciary.  Communist Russia used prostitutes for decades to turn lonely Marine guards, ambassidors, and foreign agents.  Are we supposed to be so naive that we couldn't imagine our own domestic mafia would use sexy young women to corrupt Law Enforcement, the Judiciary, the Media, or other public officials? Would you sacrifice your marriage , or would you succumb to the easy path of silence?

    The corruption goes deep into federal and state law enforcement, but they are a minority,  and at point they get sloppy as they attempt to protect each other.  

    The echoes of Enron, Worldcom, eToys , Global Crossing, and the Asbesto Ring won't be going away any time soon.

    Smelly Kelly PDF Print E-mail

    Kelly B Stapleton, who was employed by the Justice Department to protect the integrity of the bankruptcy system by overseeing case administration and litigating to enforce the bankruptcy laws, has recently resigned.

    We have limited information on Ms. Stapleton.  While we don't know what her involvement was, if any, with the eToys & Stone & Webster  bankruptcy misconduct scandals and their aftermath, we have information that Kelly Stapleton was involved with the cover-up  and tacit approval of the mushrooming WebSci Scandal.

    Experience has shown that this is going to get a lot more interesting.  As successor to Ms. Stapleton, it would appear that Roberta A. DeAngelis now holds the baton with respect to the WebSci scandals.  However, the existence of pending investigations by the FBI or other Federal authority may impede self directed efforts within the EOUST to clean up this particular mess.

    FBI raids DOJ PDF Print E-mail

    Well this Laser Haas guy is some sort of hero to me, and I'll share one of his recent eMails with ya'll below.  Here is a summary of the exciting news on the Bankruptcy Ring front:

  • The FBI raids the office of a senior DOJ lawyer responsible for protecting whistle blowers
  • Then they raid his home!
  • Diane Feinstein takes a stand against public corruption and demands an explanation  from Mukasey
  • The head of the DOJ's Criminal Division resigns


  • Dear underpaid, overworked, underappreciated BigLaw pledges:

    You will have realized by now that you will never make partner at your employer.  Or should we call your lawfirm a fee pyramid, or a Ponzi scheme, masquerading as a merit based professional corporation?

    Whatever.

    You should have known that there would never be enough room at the top.  Perhaps it doesn't matter. Your firm may very well become one of the exemplary dominoes in the unfolding backlash against the corruption of law firm protectionism as undertaken by certain DOJ lawyers on behalf of their former and prospective employers.  Like you knew years ago that Bear Stearns was going down?

    That sucking sound ain't NAFTA, it is the sound of intensive "brown nose" wheeling and dealing by your better informed superiors as they "maneuver" for some sort of safe harbor for themselves. Then, some number of front line lawyers such as you will no doubt be chosen to take one for the team. Well ... maybe not one, could be say ... three to five?

    Anyway, if you've ever watched  Survivor  or  The Batchelor  you should know by now that talent and integrity don't matter at the end of the show. There will only be so many granted immunity to continue in the game.

    Know what I mean Vern?

    So by all means, if you really do trust those people you have been working for all these years, then just stay quiet and ignorant for as long as you can with a straight face. Once this new wave of anti-corruption cathartic cleansing crashes upon the shores, it may be too late for you to wake up and take care of your family's breadwinner.  You can't barter with dirt that has already been disclosed. Once the Feds get their info - the deal window will be closed.

    Crying at the last minute only helps on Dancing With The Stars and American Idol - and believe me none of you lawyers is going to get any sympathy votes from the American public.  Not after the example prosecutions of Martha Stewart, Li'l Kim, and Barry Bonds.

    Robert S. Mueller PDF Print E-mail

    I know for a fact that there are corrupt members of law enforcement in the Department Of Justice, corrupt attorneys at various state bar associations, and corrupt members of the Judiciary, and there is at a minimum either incompetence or severe understaffing at the SEC, if not also outright corruption.

    But if there is one segment of the U.S. government where corruption is least likely to exist - it would have to be the FBI.  Below we have a speech given by Robert S. Mueller, the Director of the Federal Bureau of Investigation, which we downloaded from the FBI website  here.

    Well ... where do we start?

    We've been pestered by a Michael Moore wannabe about making a documentary.  So we might have someone deliver a complaint (or two) by hand to Mr. Mueller's office, with a camera rolling for as long as allowed. 

    Q:  Will such a complaint be placed on our website?  A:  Eventually, every elephant must take a crap.

    Huh?
    Look ... there are only so many seats in the lifeboats ... know what I mean? The big fish usually make sure that the small fish get eaten.


    Say Wha? 
    If I was a junior partner or associate, I would not gamble my young behind on the downstream loyalty of the same senior partner who's been taking home millions per year while I billed 60 to 70 hours per week.


    With the exception of Mr. Gellene and that Securities class action bucket shop, there hasn't been much of any enforcment against a BigLaw firm outside of a John Grisham novel.  But in order to illustrate what might happen if the FBI came full force into a lawfirm, let's just look what happens at a non law firm (a/k/a client) when it hits the fan and someone is needed for the chopping block.  Take for instance the Leslie Fay bankruptcy case: the entire $100 Million accounting fraud was pinned on a junior controller whose meager bonus was never affected by the firm's earnings.  (Don't have the space here to explain how Bear Stearns and some "other issues" related to that case.  We just wanted to illustrate how big crimes get pinned on little people with the help of expert private practise attorneys.)

    Who do you think the big dogs are going to select to blame the failure to disclose a conflict?

    Hint: The Big dogs aren't the ones that get rolled into Hors d'oeuvres.   

    Don't just be mean, what should I do?:
    Well, whistle-blowers exposing fraud by their own firm are protected by law.  And if you don't wait too long, being the one who provides the dirt to the FBI is what they call gettin' a stay out of jail card.  If keeping your own hintern out of prison is not enough incentive, consider how Cynthia Cooper parlayed her experience into a book, a half a dozen awards, and up to $25,000 per speaking engagementNot a bad package when you think about it really carefully.
